Terms of Service

The agreement governing your use of BrainDesk. Last updated: 04 Aug 2026.

1. Agreement

These terms form an agreement between BrainDesk and the organisation you represent. By creating an account or using the service you confirm you have authority to bind that organisation.

2. Subscriptions and plans

The service is provided on a subscription basis. Plan limits — connected products, seats, and features — are as described at purchase. Fees are billed in advance and are non-refundable except where required by law or expressly stated.

You may change or cancel a plan at any time; changes take effect at the start of the next billing period unless otherwise agreed.

3. Acceptable use

You agree not to use the service to send unlawful, abusive, or deceptive communications; to attempt to circumvent access controls or rate limits; to reverse engineer the platform; or to resell access without written agreement.

You are responsible for the conduct of users in your organisation and for the content of replies your team approves and sends.

4. Your data and your responsibilities

You retain ownership of your data and your customers’ data. You grant us the limited rights necessary to operate the service on your behalf.

You are responsible for the lawfulness of the data you connect, for the accuracy of credentials you provide, and for reviewing AI-generated drafts before they are sent. BrainDesk provides drafting and decision support; the sending decision is always yours.

5. Third-party integrations

Integrations with Gmail, Stripe, Jira, Slack, Claude, SendGrid, and your own databases are provided subject to those providers’ terms. We are not responsible for their availability, changes to their APIs, or actions you take within them.

6. Availability and support

We target 99.5% monthly uptime excluding scheduled maintenance and events outside our reasonable control, and we monitor availability continuously. Support is provided by email at support@braindesk.org; priority response is available on the Enterprise plan.

Where one connected product’s database or mailbox is unavailable, the service degrades for that product only.

7. Confidentiality

Each party will protect the other’s confidential information with at least reasonable care and use it only to perform under these terms.

8. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or lost profits or revenue. Our aggregate liability is limited to the fees you paid in the twelve months preceding the claim.

The service is provided without warranties beyond those expressly stated here.

9. Suspension and termination

We may suspend access for non-payment, for a material breach of the acceptable-use section, or where continued access poses a security risk. You may terminate at any time; on termination we will make your data available for export for a reasonable period before deletion.

10. Changes and governing law

We may update these terms; material changes will be posted on this page with an updated date. The governing law and venue applicable to your agreement will be stated in your order form or, absent one, the jurisdiction in which BrainDesk is established.
